DELAWARE — A Delaware man is in custody and faces two counts of first-degree misdemeanor aggravated menacing after allegedly threatening two juveniles during an altercation on Ross Street Wednesday afternoon.

David Lee Denny Jr., 39, was charged in Delaware Municipal Court following the incident, which occurred around 4:16 p.m. at 25 Ross St., approximately half a mile from Ohio Wesleyan University.

According to a Delaware police computer-aided dispatch (CAD) report, Denny allegedly pointed a gun at an adult who called 911.

The CAD report suggests the incident may have stemmed from road rage, while a criminal complaint filed in Delaware Municipal Court states Denny was involved in a verbal altercation with two juvenile males before nearby adults contacted police.

“During the altercation, Denny made verbal threats of serious physical harm toward both juveniles,” the criminal complaint states. “As a result of these threats, both juveniles believed Denny would carry out the threats and cause them serious physical harm.

“Fearing for their safety, the juveniles alerted nearby adults, who subsequently notified law enforcement of the incident.”

According to the CAD report, Denny drove away from the Ross Street residence toward Ohio Street approximately one minute after the initial call.

At 4:36 p.m., an officer reported having Denny “in the car.” About 14 minutes later, another officer requested additional assistance, with the dispatch log referencing Denny “making threats and scene.”

A later entry, recorded at 7:54 p.m., references a “torris 9mm,” possibly a misspelling of Taurus, a handgun manufacturer. The report does not clarify whether a firearm was recovered or what the entry specifically refers to.

According to Delaware Municipal Court and Delaware County Common Pleas Court records, Denny has previously faced eight charges in Municipal Court and two in Common Pleas Court.

He also has a separate, pending first-degree misdemeanor aggravated menacing case filed Aug. 1 in Delaware Municipal Court. A plea hearing in that case is scheduled for Nov. 16.

Court records list an Oct. 29 arraignment for Denny on the two new aggravated menacing charges stemming from Wednesday’s incident.
